This week’s learning opportunity as a Contracts Lawyer (also thanking everyone that has added me to LinkedIn this week and reading my sporadic posts) :
– Thinking along the lines of a Services Agreement with target clientele and niche business practices –
1. The first version of a finalized agreement will be tested by the Client and their customer. “Test” means when the Client needs to answer questions directed at them regarding this finalized agreement. Therefore, always hashtag#AlwaysKnowyourcontract. and ask your counsel questions prior to make sure you really understand your contract, hashtag#ownyouragreement before you head into your first meeting with a customer and play ball! Also expect the unexpected left-field question during said meeting =)
2. After a few rounds of these meetings, with meeting mental notes compiled and having the client debrief with me hashtag#ImportantDebriefDiscussion: this will be one of the most valuable learning opportunities and exercises for both of us. By putting this agreement to the test in real-world situations, we can gain insights that allow us to return to the drawing board, make necessary adjustments, and ultimately improve the agreement to make it more user-friendly hashtag#FurtherTailoringoftheContract.
3. My final point is that the process is not as linear as some might perceive it to be. We are working on it together, and there’s a significant amount of teamwork involved—sweat equity is unavoidable. Like any good piece of writing or work of art, sufficient time should be allowed to ponder, mull things over, and contemplate, avoiding the urge to rush.
– I have a feeling next week’s learning opportunity post will center around hashtag#JointVenturing with pals, hashtag#unanimousShareholdersAgreements, hashtag#CorporateEstatePlanning for business owners, and the like, or maybe a whole new direction of Wills/Estate Planning Kit for a multi-generation adult family. Who Knows! 😀 but always a fun time working with my clients through these legal puzzles and help them plan for a better, safer, more grounded future.
– Attending a Chambers networking event shortly – I’ll see some of you there 📍
